Terms of service

These terms are the agreement between you and us when you subscribe to Recommendly. They cover what we do, what it costs, how to cancel, and what we do and do not promise. Please read them before you subscribe.
1. The agreement
Recommendly is operated by Recommendly LLC, 371 7th Ave, New York, NY 10001, USA. In these terms, "we" and "us" mean Recommendly LLC, and "you" means the business that subscribes. By subscribing, or by using the service, you agree to these terms and confirm you have authority to agree on behalf of your business.
2. What the service is
We monitor public posts on platforms such as Facebook Groups, Nextdoor, Reddit and X, looking for people in your service area who publicly ask for a recommendation for the kind of work you do. When we find one, we reply in that thread and recommend your business by name. Once a month we send you a list of the posts we acted on, with the poster's display name, a link to the post and what they asked for.
A subscription covers one service in one city. We do not run ads for you, build you a website, manage your social accounts, answer your phone, or sell you leads collected by anyone else.
3. Who can subscribe
The service is for businesses only, not for consumers. You confirm that you are at least 18, that your business is properly registered where that is required, and that you hold the licences, permits, insurance and qualifications the law requires for the work you advertise. We may ask you for proof, and we may end the agreement if you cannot provide it.
4. Your business information
After you subscribe, you give us the details we need: what you do, your city and service area, your contact details, and the page or profile we should link to. You are responsible for that information being accurate and current, and for telling us when it changes.
Anything we say about your business comes from what you tell us, so you are responsible for its accuracy. You must not ask us to state anything untrue, and we will not write claims we have reason to believe are false. We do not post reviews written as if we were your customers, and we will not create fake reviews or testimonials.
5. How we post and what we disclose
You authorise us to name your business, describe your services and link to your page in public posts, for as long as your subscription is active.
Because you pay us, there is a material connection between us and your business. We disclose that connection in our posts where the law or the platform requires it, including under the guidance of the US Federal Trade Commission, and we follow the rules of each group and platform we post in. You agree that we may identify our posts as paid or sponsored, and that you will not ask us to hide the relationship.
If you want our posts to read a particular way, tell us and we will apply it as long as it stays truthful and within the rules above.
6. No guarantee of results
We do not promise a number of leads, calls, quotes, jobs or any amount of revenue. How many people ask for a recommendation in your area, and how many of them contact you, is outside our control. It depends on demand, the season, the platforms, your reputation and how quickly you respond. Nothing on our website or in our messages is a guarantee of results.
7. Third-party platforms
Facebook, Nextdoor, Reddit and X are independent of us. We are not affiliated with, endorsed by, or sponsored by any of them, and we do not control what they do. They can change their rules, remove a post, restrict a group, or limit an account at any time, and groups are run by their own moderators who may not allow recommendations at all.
If that happens we will look for other places to recommend you, but we are not responsible for a platform's decisions, and those decisions do not entitle you to a refund. You accept that this makes results uneven from month to month.
8. Fees, billing and cancellation
- The price is $350 per month, in US dollars, for one service in one city.
- The subscription is billed monthly in advance, starting on the day you subscribe, and renews automatically on the same day each month until you cancel.
- Payment is taken by PayPal. You authorise the recurring charge when you subscribe.
- Prices exclude any sales tax, VAT or similar tax, which is added where it applies.
- You can cancel any time, either by cancelling the subscription in your own PayPal account or by emailing [email protected]. Cancellation takes effect at the end of the month you have already paid for, and we stop recommending you from that point. There is no cancellation fee and no notice period.
- We do not give refunds for part of a month, or for months where the results were lower than you hoped. If we fail to deliver the service at all in a month you have paid for, email us and we will refund that month.
- If a payment fails we may pause the service until it is settled. If it stays unpaid for 14 days we may end the agreement.
- We can change the price with at least 30 days notice by email. The new price applies from your next renewal, and you can cancel before then.
9. Working the leads
When someone contacts you after our recommendation, your dealings with them are entirely between you and them. We are not a party to that contract, we do not vet the people who post, and we do not promise that anyone who contacts you will hire you, be able to pay, or be who they say they are. You are responsible for the work you do and for how you handle their information.
10. Intellectual property
This website, its text, design and graphics belong to us. You may not copy or reuse them except as the law allows.
Your business name, logo and content stay yours. You grant us a limited, non-exclusive, revocable licence to use them for the purpose of recommending your business while your subscription is active. The monthly list we send you is yours to use in your business.
11. Suspension and termination
You can cancel any time, as set out above. We may suspend or end the service, with a refund of any unused month you have paid for, if you break these terms, if you ask us to post something false or misleading, if your licences or insurance lapse, if your conduct puts our accounts or reputation at risk, or if we stop offering the service in your area. We may also end the agreement for any reason with 30 days notice.
12. Disclaimer
The service is provided as it is and as available. To the extent the law allows, we exclude all implied warranties, including any implied promise that the service will be uninterrupted, error free, fit for a particular purpose, or that it will produce any particular commercial outcome. Some jurisdictions do not allow these exclusions, in which case they apply to you only as far as the law allows.
13. Limitation of liability
To the extent the law allows, we are not liable for lost profits, lost business, lost goodwill, lost data, or any indirect or consequential loss, even if we were told such loss was possible.
Our total liability to you for all claims connected with the service is limited to the fees you paid us in the three months before the event that caused the claim.
Nothing in these terms limits liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot be limited by law.
14. Indemnity
You agree to cover our reasonable losses, costs and legal fees if a third party brings a claim against us because of information you gave us that was untrue or misleading, because of work you did or failed to do for a customer, or because you did not hold a licence, permit or insurance you were required to hold.
15. Changes to the service and these terms
We may change how the service works, including which platforms we monitor, as platforms and their rules change. We may update these terms by posting a new version here with a new date. If a change materially affects you we will email you at least 30 days before it takes effect, and you can cancel before then if you do not accept it. Continuing to use the service after that date means you accept the new terms.
16. Governing law and disputes
These terms are governed by the laws of the State of New York, USA, and the courts of the State of New York, USA have exclusive jurisdiction over any dispute. Before starting a formal claim, please email us so we can try to sort the problem out directly.
17. General
These terms are the whole agreement between us about the service, and they replace anything said before. If a court finds part of them unenforceable, the rest stays in force. If we do not enforce a term straight away, we do not lose the right to enforce it later. You may not transfer this agreement without our written consent. We may transfer it to a company that takes over our business. Nothing here makes us partners, employer and employee, or agent and principal, beyond the authority you give us to post about your business.
